End of employment, notice and probation in dental clinics

Knowing how a job can end helps you choose a good one. Here are the rules on probation, notice and end of employment in dental clinics.

How long is the probation period in a dental clinic?

The law sets no probation period; clinics generally provide three months, sometimes six. During that period labour standards still apply: pay, breaks, leave. Notice of termination is only required after three months of continuous service.

Can I be dismissed without reason during probation?

Before three months, the employer does not have to give notice, but it cannot dismiss you for a prohibited reason (pregnancy, complaint to the CNESST, illness, absence for family obligations, etc.). After two years of service, you can contest a dismissal without good and sufficient cause.

How much notice must the employer give for a layoff?

One week after three months of service, two weeks after one year, four after five years, eight after ten years. Failing that, it pays an equivalent indemnity. This notice does not apply in case of the employee’s serious misconduct or to fixed-term contracts that have ended.

How much notice must I give if I resign?

The law imposes no precise notice, but the Civil Code speaks of a « reasonable » delay; two weeks is customary, and more for a key position (coordinator, sole hygienist). Check your contract: a clause may provide for longer notice, but the employer cannot withhold your pay if you do not respect it.

What is constructive dismissal?

A unilateral and substantial change to your conditions (pay cut, major schedule change, demotion) that pushes you to resign. You can then file a complaint as if it were a dismissal. Document the changes and consult the CNESST quickly.

Which documents should you receive at the end of a job?

The last pay with accumulated vacation indemnity, the record of employment (sent to Service Canada within five days) and, on request, a letter confirming your position and dates. The record of employment is needed for employment insurance.

Can a clinic make me pay for my training if I leave?

Only if a written contract clearly provides for it, for costly, non-mandatory training, and proportionally to the time remaining. Training required for the job (software, protocols) cannot be charged. Have any repayment clause reviewed before signing.

Are fixed-term contracts common in dental clinics?

They are used mainly for maternity leave replacements (hygienists, receptionists). They end on the set date without notice, but if you keep working afterwards, the contract becomes indefinite. A replacement is often a gateway to a permanent position.

How does an amicable departure work?

With polite written notice, an organized transition (files, patients, sterilization) and a reference letter. The dental world is small: leaving properly protects your reputation. A clinic that treated you well deserves the same respect.
